The “www.erp-csmart.com” site is a service published by Compta Smart, part of the Facnote Group, a SAS registered with the Marseille Trade and Companies Registry under number 813 779 691, whose head office is located at 73 boulevard Viala 13015 Marseille, which also manages the publication through the intermediary of its legal representative.

The www.erp-csmart.com and https://www.erp-csmart.com websites, as well as all online software, are hosted by : OVH SAS with capital of €10,059,500 RCS Lille Métropole 424 761 419 00045, head office: 2 rue Kellermann – 59100 Roubaix – France.

Use of the www.erp-csmart.com website is governed by the present terms and conditions of use, which are available on the www.erp-csmart.com website. By using the site, you acknowledge that you have read and accepted these conditions. Groupe Facnote reserves the right to modify them at any time and without prior notice.

Intellectual property: www.erp-csmart.com is a Groupe Facnote Consulting website. All content on the www.erp-csmart.com site, including graphics, images, texts, logos and icons, as well as their layout, are the exclusive property of Groupe Facnote, with the exception of trademarks, logos or content belonging to other partner companies or authors.

Any reproduction, distribution, modification, retransmission or publication of these elements is strictly forbidden without the express written consent of Groupe Facnote Consulting. For any request for authorization or information, please send an email to the Contact section.

Limitation of liability: The information contained on the erp-csmart.com site is as accurate as possible and the site is periodically updated, but may nevertheless contain inaccuracies, omissions or gaps.

Personal data

In accordance with the French Data Protection Act of January 6, 1978, the collection of personal data and any processing of such data by the Site have been previously registered with the Commission Nationale de l’Informatique et des Libertés under number: 1764571. Any person may access this information by writing to the CNIL, 21 rue Saint Guillaume, 75340 Paris cedex 07, or by e-mail to decweb@cnil.fr.

The operation of the Site may involve the collection of a certain amount of personal data from Internet users (Visitors, Users). The main purpose of this data collection is to ensure that the Site is displayed correctly on the user’s screen and to compile general visitor statistics.

Certain personal data may be collected through the use of “cookies” files recorded by the server hosting the Site on the Visitor’s hard disk in order to facilitate navigation on the Site or to establish general static data on Site traffic.

Browser-based cookie deactivation options :

  • Internet Explorer (Microsoft) : In the Tools menu, click on Internet Options. Click on the Security tab. Click on the Internet icon. Click on Personalize Level. Choose Deactivate in the Cookies paragraph (2 times). Click on OK (2 times).
  • Firefox (Mozilla Foundation) : In the Tools menu, select Options from the tree. Click on Delete Cookies or Delete all information. Click on OK.

In accordance with article 39 of law n°78-17 of January 6, 1978, modified by law n°2004-801 of August 6, 2004, any Visitor or User has the right to access, modify, rectify and delete data concerning them. These rights may be exercised by contacting Groupe Facnote by post at BMBYS Consulting, 73 boulevard Viala, 13015 Marseille, or by e-mail at support@comptasmart.com.

Application solutions and security

Groupe Facnote provides the Customer with Solutions accessible on its server via the Internet network and grants the Customer the non-exclusive right to use Groupe Facnote Solutions.

Secure hosting: OVH, with physical access controls to server rooms, redundant power supplies, fire and intrusion protection, and daily backups.

Groupe Facnote provides Data hosting, maintenance and security for the Solutions. Secure server hosting with a specialized service provideŕ currently OVH, with physical access control to the server rooms; redundant power supplies, air conditioning, firé and intrusioń security. Our accommodations are located in France and can extend to Europe.

Daily data backups.

Services are provided in accordance with the “rules of the trade” and with an obligation of means.

Network

Groupe Facnote cannot be held responsible for network line interruptions.

Access to solutions

The Customer is granted access rights for the number of users specified. He may connect at any time – with the exception of maintenance periods:

  • 24 hours a day,
  • 7 days a week
  • including Sundays and public holidays,

Access is via the customer’s fixed or mobile computer, using the user ID and password supplied to the customer.

Identifiers are intended to restrict access to the Solutions covered by the Contract to the Customer’s Users, to protect the integrity and availability of the Solutions, and the integrity, availability and confidentiality of the Customer’s Data as transmitted by Users.

Identifiers are personal and confidential. They may only be changed at the Customer’s request. The Customer undertakes to do everything in his power to keep his Identifiers secret and not to divulge them in any form whatsoever. The Customer is entirely responsible for the use of the Identifiers and for the safekeeping of the access codes issued to him. The Customer shall ensure that no other unauthorized person has access to the Application Services and Solutions. In general, the customer assumes responsibility for the security of individual workstations accessing the Solutions. In the event that the Customer becomes aware that another person is accessing the Solutions, the Customer will inform Groupe Facnote without delay, and will confirm this by registered mail.

In the event of loss of one of the identifiers, the Customer should contact the teams at the following e-mail address: support@comptasmart.com.

Application quality

The Customer is aware of the technical hazards inherent in the Internet, and of the access interruptions that may result. Consequently, Groupe Facnote cannot be held responsible for any unavailability or slowdown of the Application Services. Furthermore, it is the Customer’s responsibility to respect the volume thresholds recommended by Groupe Facnote and to inform Groupe Facnote in the event of an increase in its needs in terms of processing capacity.

The Application Services may occasionally be suspended due to maintenance work necessary for the proper operation of Groupe Facnote’s servers. In case of interruption of the Application Services for maintenance, Groupe Facnote undertakes to inform the Customer so that he can make arrangements sufficiently in advance to avoid any disruption of his activity. Groupe Facnote cannot be held responsible for the possible impact of this unavailability on the Customer’s activities.

Secure HTTPS access (data encryption: 128-bit encryption).

  • Authentication by database-encrypted login and password (irreversible encryption algorithm).
  • Data access rights and authorizations through user and rights management.
  • Each user has access only to the data that concerns him or her and that is authorized according to the rights assigned to him or her by the Customer.

Licenses

Groupe Facnote grants the customer a personal, non-exclusive, non-assignable and non-transferable right to use the Solutions, for the entire duration of the Contract and for France.

The Customer may only use the Application Services and Solutions in accordance with its needs. In particular, the license for the Solutions is granted for the sole and exclusive purpose of enabling the Customer to use the Services, to the exclusion of any other purpose. The right of use refers to the right to represent and implement the Application Services in accordance with their intended purpose, in SaaS mode via a connection to an electronic communications network.

Under no circumstances may the Customer make the Solutions available to a third party, and the Customer strictly prohibits any other use, in particular but not limited to any adaptation, modification, translation, arrangement, distribution or decompilation.

Maintenance

Groupe Facnote provides support and maintenance for the Solutions.

A telephone support service to deal with anomalies is available from Monday to Friday, 9 am to 6 pm. Serious anomaly reports must be confirmed by email without delay directly to Groupe Facnote. Groupe Facnote will diagnose the anomaly and correct it as soon as possible.

Groupe Facnote does not guarantee the correction of anomalies in the following cases:

  • Customer’s refusal to cooperate with Groupe Facnote in resolving anomalies and, in particular, to answer questions and requests for information;
  • Use of Application Services in a manner that does not comply with their intended purpose;
  • Unauthorized modification of the Solutions by the Customer or a third party;
  • Failure of the Customer to meet its obligations under the Contract ;
  • Implementation of any software packages, software or operating systems that are not compatible with Application Services;
  • Internet network failure ;
  • Deliberate act of damage, malice, sabotage ;
  • Damage due to force majeure or misuse of application services.

The Customer benefits from updates and functional evolutions of the Application Services. Corrections to Application Services are expressly included in the Contract.
